NIE appointment in Spain: what to do when there are no cita previa slots

The screen says En este momento no hay citas disponibles. You refresh, change the province, try again at midnight, and get the same sentence. Somewhere in a Facebook group, someone offers to sell you a slot for eighty euros.

That is where most NIE applications stall, and it is worth being precise about what is actually happening. The appointment is a way of managing a queue. It is not what the law requires in order to file.

What a cita previa actually is

Appointments for immigration procedures are booked through the state system at sede.administracionespublicas.gob.es, province by province. You pick a province, pick the procedure, enter your passport number and name, and the system either offers a slot or tells you there are none.

Two things follow from that design. Availability is provincial, so where you live decides which queue you are in. And the appointment is free. There is no official charge for booking one, at any office, in any province.

The appointment is not the legal requirement

This is the part that almost never gets said. Article 16.4 of Ley 39/2015 sets out where a document may lawfully be filed with the Spanish administration:

  • the electronic register of the body it is addressed to, or any other electronic register
  • a post office, in the prescribed form
  • a Spanish diplomatic mission or consulate abroad
  • an office providing registry assistance
  • anywhere else that current legislation allows

An appointment slot is not on that list, because it is not a place of filing. It is a device the offices use to schedule counter service. That distinction matters when nobody can find a slot: the absence of an appointment is an obstacle to being seen at a counter, not a bar on your application existing.

Article 14 of the same law sets out who files how. Individuals may choose between paper and electronic. Certain groups, including professionals acting in that capacity, are obliged to deal with the administration electronically. For immigration files that means the Mercurio platform, and documents submitted by any other route are treated as not having been filed at all.

Which is the plain reason a law firm can process a NIE without you ever booking a slot. It is not a trick or a shortcut. Lawyers are on a different, mandatory channel, and that channel does not run on appointments.

Never pay for an appointment

Because appointments are free and scarce, a market grew around them. Automated scripts take slots the moment they appear and resell them through messaging apps and social media. Networks doing this have been dismantled by Spanish police, and the practice continues to resurface.

Two reasons not to take part, beyond the obvious one. A booking is made in your name with your passport number, so buying one means handing your identity details to a stranger whose business model already depends on abusing a public system. And a slot bought from a reseller confers nothing extra: the appointment still requires the same forms, the same fee and the same documents.

The same goes for the folklore about release times. Claims that slots appear at a specific hour circulate widely and have no official basis. Availability is not published on a schedule.

Where the appointment sits, city by city

Appointments are provincial, which surprises people who live in a well-known town that is not a provincial capital.

  • Madrid. Its own province, and the busiest queue in the country. How we handle a NIE for Madrid.

  • Valencia. The provincial office covers the city and the surrounding towns. NIE in Valencia.
  • Alicante and Torrevieja. Torrevieja, Benidorm, Orihuela Costa and Jávea all sit in Alicante province, so they share one queue. Alicante and Torrevieja.
  • Málaga. Covers Marbella, Estepona, Fuengirola and the rest of the Costa del Sol. NIE in Málaga.
  • Mallorca. Palma serves the whole Balearic province. NIE in Palma.
  • Tenerife. Santa Cruz for the western Canaries. NIE in Tenerife.

The number itself is national. It makes no difference to the NIE which province issued it.

If you are going to book it yourself

Have the passport open in front of you, because the name and number must match exactly what the document says, including second surnames. Fill in form EX-15 beforehand and pay the fee, currently €9.84 under Orden PJC/617/2025, so that a slot appearing at short notice is usable.

Bring the reason you need the number. A purchase agreement, an employment contract, a notarial instruction. Applications are routinely turned away for having everything except the document that explains why the applicant needs a NIE at all. Frequently asked questions

Can I book an appointment in a different province to get one sooner?
The system will let you, and the number is valid nationally. Whether the office accepts it depends on whether you can show a connection to that province, so treat it as a gamble rather than a plan.

How much does a cita previa cost?
Nothing. The €9.84 fee is for the NIE itself, paid on form 790 code 012, not for the appointment.

Is it legal to buy an appointment?
Selling public appointments is not a legitimate business and networks doing it have been broken up. Beyond the legal question, it means giving your passport details to a reseller.

Can someone attend the appointment for me?
Yes, with a power of attorney. That is the mechanism behind an application handled entirely by a firm on your behalf.
